The Queensland Building and Construction Commission (QBCC) is Queensland’s building and construction regulator. Our mandate is to independently regulate the building and construction sector, and efficiently manage the Queensland home warranty insurance fund (the Queensland Home Warranty Scheme).

Adjudication Registrar

The purpose of the position is to manage the Adjudication Registry. The registry is a statutory function established by the Building Industry Fairness (Security of Payment) Act 2017 (BIF Act), to provide a way for a party to a payment dispute to seek adjudication of the dispute from an adjudicator appointed under the BIF Act. The functions of the registry include appointing and renewing the appointments of adjudicators, ensuring that adjudicators meet their continuing professional development requirements, deciding on complaints made against adjudicators and educating and raising awareness with stakeholders about rights and responsibilities related to the adjudication process.

Key outcomes/accountabilities

The aim of this role is to:

  • Lead the operations of the Adjudication Registry and ensure that it is managed in accordance with the BIF Act including meeting statutory timeframes for referring adjudication applications to adjudicators.

  • Allocate or arrange for appropriate allocation of adjudication applications to adjudicators.

  • Administer the registration of adjudicators including: assessing applications to become registered as an adjudicator or to renew registration; the continuing professional development requirements for adjudicators; and deciding on allegations of breaches by adjudicators of their code of conduct.

  • Identify and nominate training organisations responsible for training people wanting to be registered as adjudicators.

  • Lead ongoing education of and engagement with consumers about the role of the registry and the adjudication process.

  • Review and analyse the operation of the BIF Act 2017, and if necessary, make recommendations for amending the legislation to improve its effectiveness.

  • Set the strategic direction for the registry and for the adjudication process, including leading the development of policies and procedures, identifying emerging issues, risks and opportunities, and providing timely, relevant, specialist information and expert advice to the Commissioner (or their delegate), the Board and the Minister.

  • Lead the continual improvement of services provided by the registry, seeking to bring about improvements in service and greater consistency.

Reporting:

  • Collect statistical data and other information relevant to the administration of the registry for the commissioner's report to the Minister under section 157 of the BIF Act.

  • Provide high-quality advice, briefs, submissions, presentations, and reports to influence the development and adoption of sound integrity, governance, and risk management practices across the QBCC.

  • Ensure the provision of effective, consistent and timely performance metrics and reporting to assist strategic decisions and direction setting

Candidate attributes

The ideal applicant for this role will be someone who can demonstrate the following key attributes as they apply to the key accountabilities of the role.

  1. Leadership and resource management (including financial management) skills supported by a record of achievement in delivering high quality performance outcomes and customer service.

  2. Substantial knowledge and experience of public administration including the ability to apply, interpret and provide high quality advice about legislation, policy and procedure relevant to building or dispute resolution processes.

  3. Experience in implementing a change agenda through innovative and strategic solutions to complex issues and managing a range of projects with conflicting timeframes.

  4. Demonstrated leadership and management skills, including: a commitment to the health, safety and wellbeing of employees, the ability to guide and develop staff as a high performing team, staff performance management and appropriate tasking to ensure balanced workloads while delivering results under statutory timeframes.

  5. High level communication, interpersonal and negotiation skills with a proven ability to develop collaborative relationships with a broad range of stakeholders internally and externally.

Mandatory Requirements

  • Admitted, or eligible to be admitted, to the legal profession.

Other Requirements

  • This position description provides the minimum requirements for the position. The incumbent may be required to undertake other duties as required.

  • Delegations and authority to act – this position may be required to exercise certain powers in accordance with legislation and QBCC’s business delegations.

  • All staff must comply with their responsibilities under the applicable legislation. Including the following:

    • Work Health and Safety Act 2011 (QLD)

    • Public Sector Ethics Act 1994, including the Code of Conduct for the Queensland Public Service

    • Public Sector Act 2022 (QLD)

For a Registrar, Section 150 of the Building Industry Fairness (Security of Payment) Act 2017 (BIF Act 2017) has specific requirements for the appointment and requirements of the Adjudication Registrar as outlined below. This role is appointed under the BIF Act 2017 and not the Public Sector Act 2022 and will be appointed by the Govenor in Council. This role requires an ability to meet the requirements of s150.  

Section 150 Adjudication registrar

1. There is to be an Adjudication Registrar (the registrar).

2. The registrar is appointed by the Governor in Council

3. A person is eligible for appointment as the registrar only if the person-

(a) is eligible for admission in the legal profession under the Legal Profession Act 2007, section 30; and

(b) has particular knowledge and experience of public administration or other matters of substantial relevance to the functions of the registrar.

Examples of other matters for paragraph (b)- the application of laws relating to building or dispute resolution processes

Section 151

A person is disqualified from being appointed as the registrar if the person:

(a) has a recorded conviction, other than a spent conviction, for an indictable offence; or

(b) is, or has been, convicted of an offence against this Act; or

(c) is an insolvent under administration within the meaning of the Corporations Act, section 9; or

(d) is not able to manage a corporation because of the Corporations Act, part 2D.6; or

(e) is a member of the board within the meaning of the Queensland Building and Construction Commission Act 1991; or

(f) is a person engaged by the commission under a contract to provide advice or a particular service
